Bookings
When you decide to make a booking with us, we will visit you to discuss your visions of your special days. At this meeting we will share ideas and discuss with you the way you would like day the photograph or video captured.
Deposit
When you decide to make a booking with us for either a photography or videography package we will require a deposit of 60% of the package to confirm the booking of your date. The balance of payment will be due a minimum of 14 days prior to your programme date.
Coverage
The photographer/videographer cannot be held responsible for lack of coverage caused by the party etc not arriving at the pre-agreed times. The photographer/videographer cannot be held responsible for lack of coverage due to the church, register office, licensed place or venue having restrictions on our work.
Weather and Illness
Your event pictured cannot be held responsible for photography/Videography being disrupted or cancelled due to adverse weather conditions. Also we shall not be liable for any amount in excess of the retail value of the packages that has been booked if no photographer/Videographer to cover the event of illness and equipment failure.
Licences Required
SAFRISCO Media Solutions (SMS) cannot be held responsible for any church or Venue not allowing Photography or Videography to take place on their premises. Any permission and the cost of such permission are the responsibility of the person making the bookings.
It is agreed that the terms set out in this booking form is the total agreement made between the parties and no variations or modifications of this contract shall be effective unless agreed by both parties in writing.
Special Requests/ Coverage
The client understands and accepts that the video coverage will be as the videographer’s professional expertise determines and that no one shot will be deemed more important than another. Special requests are not binding instructions, although every effort is made to comply with the clients wishes.
Images
All image sizes are nominal. The videographer’s will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to record on film the exact colour as seen by the human eye.
Copyright
Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created as part of this contract without the permission of SAFRISCO Media Solutions (SMS) in writing.
Majeure or Act of God
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.
Display
The client hereby allows SAFRISCO Media Solutions (SMS) to display any images included in this contract in their studios, portfolios. Wedding exhibitions, website and advertising materials. no use of the images will be made by SAFRISCO Media Solutions (SMS) for other commercial reason except with the written permission of the client
Limitation of Liability
In the unlikely event of a total videographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
Refreshment
Due to demands of the day, the client agrees to provide a main meal for the Videographer’s
Exclusive Right:
SAFRISCO Media Solutions (SMS) shall be the exclusive videographer or Photographer retained by the client for the purpose of filming or taking pictures at the event. Family or friends shall be permitted to take pictures or film the occasion for their private use as long as they don't interfere with the official videographer or photographer. Such a person will be ask to stop filming or stop taking pictures by
SAFRISCO Media Solutions (SMS) team at the event.
Ownership of the Master Tape and copyright
The master tape remains our property. Copyright in the master tape is vested in us. This means that:
- we reserve the right to dispose of the master tape in our absolute discretion.
- we do not accept liability in relation to any loss of and/or damage to the master tape.
- neither you nor any one on your behalf are allowed to make any copies of any tapes, discs or other recorded media unless we have agreed in writing that you may do so.
Please note that the copying of tapes or discs without our consent is a breach of copyright for which you may be liable in damages. Master tapes or discs are kept for a period of one year. We reserve the right after you have received your copy of the DVD, to show the disc or part of it to any prospective client who may wish to see a sample of our work, or to enter the disc into competitions or use extracts in our show reel. We will not however release any part of your video for a public showing or broadcast without your prior written consent. We confirm that we will comply with the provisions of the Data Protection Act 1998 as it relates to your personal data. Please note that we shall be entitled to assume unless you inform us otherwise prior to the Event that all persons attending the Event have consented to being recorded.
